The O-1 visa is a distinguished pathway for professionals with extraordinary ability in science, business, education, athletics or the arts to build a career in the United States. It opens access to top-tier positions, international recognition, and eventually a green card and citizenship.

Legal framework and categories

To qualify for O-1, applicants must show national or international recognition for sustained excellence in their field — proving they belong to a small percentage of professionals at the top of their discipline.

O visa categories

  • O-1A — for individuals with extraordinary ability in sciences, education, business or athletics.
  • O-1B — for individuals with extraordinary ability in the arts or achievement in motion picture or television production.
  • O-2 — for essential support personnel of an O-1 holder.
  • O-3 — for the spouse and unmarried children of an O-1/O-2 holder.

Requirements

Applicants need a major international award (such as a Nobel Prize or an Olympic medal) or at least 3 of 8 statutory criteria: prizes and awards, membership in professional associations, published material about the applicant, judging others' work, authorship of articles or patents, a critical role in distinguished organizations, high remuneration, or other comparable evidence. A peer advisory opinion is also required. Petitions must be filed by a US employer or agent — self-petitioning is not allowed.

How to get the O-1 visa: step by step

Find a sponsor

Confirm your achievements are extraordinary and find a US employer or agent willing to file the petition on your behalf.

Gather evidence

Prepare a portfolio: diplomas, media coverage, recommendation letters, contracts, project descriptions and a peer advisory opinion.

File Form I-129

Your employer files Form I-129 with all supporting documents, no earlier than 12 months and no later than 45 days before the start date.

Wait for a decision

USCIS typically adjudicates in 2–4 months, or up to 15 days with premium processing. Approval results in Form I-797.

Attend the interview and enter the US

If you are abroad, file DS-160 and attend a consular interview. The visa allows entry up to 10 days before work begins.
